ECOWAS COURT DELIVERS JUDGMENT ON ALLEGED EXTRA-JUDICIAL KILLINGS OF FIVE NIGERIANS

The Community Court of Justice of ECOWAS has, once again, shown its resolve to uphold its protective mandate and advance the safeguards of the African Charter and other applicable human rights treaties for the benefits of all citizens of ECOWAS. It is hoped that Nigeria would show leadership by complying fully with the recent order of the court mandating it to "conduct ‘appropriate inquiries’ into the disappearance of five Nigerians on 13th October 2010 after they were taken into police custody in Benin, Edo State, Nigeria".

Statement on the Recent Incident Involving the Nigerian Military and the Shiite Islamic Movement.

Whatever may be the justification, the event of Saturday 12, December, 2015, involving the Nigerian military and the Shiite Islamic Movement calls for sober reflection on the way we conduct ourselves whether as private citizens or as public officials. The legality of the use of lethal force by the military of a country against the citizens of that country is one that must be strictly construed against the military and condemned as unlawful unless justified as the last resort in the circumstance of any particular event. Such use of lethal force should be necessary and proportionate to the situation; and provocation should not be a defence.

The Committee on Justice and Human Rights (CJHR)

The Committee on Justice and Human Rights (CJHR) is a Committee of the Nigerian Branch of the International Law Association (ILA)http://www.ila-hq.org/. The CHJR aims at taking a pragmatic approach to human rights and justice as mutually inclusive concepts with a view to understanding how and why the concept of justice for human rights violations enhances or diminishing the safeguards of human rights instruments and provisions in Nigeria, in particular, and Africa, in general. It draws on the intellectual resources of its members and the ILA in carrying out its work, which is predominantly of a preventive nature. It also relies on the goodwill and donations of stakeholders in the fields of human rights and justice.
